Terms for direct customers

Last updated: 19 October 2026

These terms apply to customers who use KSeF Faktury directly: through the WooCommerce plugin, the PrestaShop module or their own integration with our API. They do not apply to the Shopify app, which has its own terms of service and is billed by Shopify.

1. Provider

1.1. The KSeF Faktury service (the "Service") is provided by LLC Lytvynov Production (ТОВ «ЛИТВИНОВ ПРОДАКШН», EDRPOU 43293825), a company under Ukrainian law, address: Robocha street 164A, apt. 58, 49008 Dnipro, Ukraine, email: kontakt@ksefshop.pl, website: https://ksefshop.pl (the "Provider", "we").

1.2. These terms govern the use of the Service by a business that opens an account directly with us (the "Customer").

1.3. The WooCommerce plugin, the PrestaShop module and the API are in early access. During early access accounts are opened by invitation, and live mode and paid plans are switched on gradually. These terms apply from the moment an account is opened.

2. Service

2.1. The Service issues VAT invoices (FA(3)) and correction invoices for the Customer's paid orders and sends them to the National e-Invoicing System (KSeF) run by the Polish Ministry of Finance. The Service provides:

2.2. An account has two modes. Test mode runs on the KSeF test environment (KSeF TEST), is free and has no invoice limit; test invoices have no legal or tax effect. Live mode runs on production KSeF; invoices in this mode are the Customer's invoices under the Polish VAT Act.

2.3. The Service covers orders of buyers with a Polish NIP, in PLN or in a currency of NBP table A (VAT converted to PLN at the NBP rate). KSeF is operated by the Ministry of Finance and its availability is outside our control. When KSeF is unavailable, invoices wait in the queue and are sent when it is back.

2.4. Technical requirements: a device with internet access and an up-to-date browser supporting TLS 1.2 or later; for the plugin, WordPress with WooCommerce in the version stated in the plugin description; for the PrestaShop module, the PrestaShop version stated in its description; for the API, an HTTPS client. The Customer needs a valid KSeF certificate or KSeF token for its NIP. Using any internet service carries general risks (for example malware or phishing); keep your devices updated and your API keys secret.

3. Account, API keys and acceptable use

3.1. An account is opened in the panel by giving an email address, seller data (NIP, name, address) and an invoice number pattern. The contract is concluded when the account is opened and these terms are accepted, for an indefinite period.

3.2. Access to the API and the panel uses secret keys (sk_test_..., sk_live_...). A key is shown once; we store only its hash. The Customer keeps keys secret, does not share them with unauthorised persons and generates a new key in the panel without delay if it suspects disclosure. Actions performed with the Customer's key are deemed actions of the Customer.

3.3. The Customer may not use the Service for unlawful activity or fraud, send unlawful content through it, infringe the intellectual property of others, try to bypass plan limits or security measures, or disrupt the Service (for example by exceeding request limits).

3.4. The software, the API and the documentation remain our intellectual property. The Customer gets a non-exclusive, non-transferable right to use them for the term of the contract to issue its own invoices.

4. Customer's responsibilities

The Customer is the issuer of the invoices and is responsible for:

The Service is a software tool. We do not provide tax, accounting or legal advice.

5. Plans and limits

5.1. Plans (net prices in PLN):

Plan Invoices per month Monthly Yearly
Free 5 PLN 0 PLN 0
Start 100 PLN 29 PLN 290
Pro 500 PLN 59 PLN 590
Unlimited no limit PLN 99 PLN 990

5.2. The Free plan requires no payment and no payment details, and has no time limit. All plans have the same features.

5.3. Prices are net. Paddle adds VAT or another tax at checkout according to the Customer's country and status (for example reverse charge for a business with a valid EU VAT number). The Customer sees the full amount before confirming the payment.

5.4. The limit applies to live mode. We count VAT invoices and correction invoices that are queued, being sent or accepted by KSeF in the calendar month (UTC). Test mode has no limit.

5.5. One subscription covers all of the Customer's stores and integrations that the Customer links to it in the panel. We charge no per-store fee; the plan limit is shared by all linked stores.

5.6. When the limit is used up, new orders wait without an invoice number until the plan is changed or the next month starts, and are then invoiced automatically. Numbering stays gapless and no order is lost. The panel shows how much of the limit is used. The Customer remains responsible for issuing invoices on time under the VAT Act, also while an order waits for the limit; if that matters, upgrade the plan or issue the invoice by other means.

6. Payments through Paddle

6.1. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

6.2. Paid plans are sold by Paddle.com Market Limited or, depending on where the Customer is located, another Paddle company (together "Paddle"). The purchase is governed by the Paddle Buyer Terms (https://www.paddle.com/legal/buyer-terms), which the Customer accepts at checkout. Paddle collects the payment, calculates and accounts for taxes and issues the invoice or receipt for the subscription. We provide the Service itself under these terms.

6.3. Payment methods are shown in the Paddle checkout. We do not receive or store card numbers or other payment instrument data.

6.4. The subscription renews automatically for the next period (month or year) until cancelled. The Customer manages the subscription in the panel (Plan and billing) and in the Paddle customer portal, where it downloads invoices and changes the payment method.

6.5. Plan changes:

6.6. Refunds follow our Refunds and cancellation policy, including a 14-day refund on the first purchase of a paid plan, and the Paddle Buyer Terms.

6.7. If a payment fails, Paddle retries the charge and the plan keeps working meanwhile. If Paddle pauses or cancels the subscription, the account moves to the Free plan and orders over the limit wait as described in 5.6.

6.8. We announce price increases by email at least 30 days before they take effect. The new price applies from the first billing period after that date. The Customer may cancel the subscription before then.

7. Data protection

7.1. For the personal data of the Customer's buyers we act as a processor under art. 28 GDPR, and the Customer is the controller. We process that data only to provide the Service and on the Customer's documented instructions, which are these terms and the Customer's settings and API calls. We keep the data confidential and bind our staff to confidentiality; use the sub-processors listed in the Privacy Policy, which the Customer authorises (we announce changes in advance and the Customer may object); apply appropriate technical and organisational security measures; help the Customer answer data subject requests and meet its obligations under art. 32-36 GDPR; report a personal data breach without undue delay and at most within 48 hours of becoming aware of it; make available the information needed to demonstrate compliance and allow audits; and at the end of the contract delete the data or return it, except invoices that the law requires to be kept. A separate data processing agreement (DPA) with these terms is available on request at kontakt@ksefshop.pl.

7.2. We process the Customer's own data as a user of the Service (email, company data, sign-in data, and billing data passed on by Paddle) as a controller, as described in the Privacy Policy.

7.3. KSeF certificates, private keys and KSeF tokens are stored encrypted (AES-256-GCM, key kept outside the database), never shown again and used only to send the Customer's invoices and read their status. The key password is used once and not stored.

8. Availability and changes

The Service is provided "as is". We aim for continuous availability but do not guarantee it. We may change the Service, for example to follow changes of the FA schema or the KSeF API. Backward-incompatible API changes are announced in advance in the API documentation. We announce changes of these terms by email at least 30 days before they take effect, unless a change is required by law sooner; a Customer who does not agree may terminate the contract before then.

9. Liability

We are not liable for indirect loss, lost profit, or tax penalties, interest or sanctions resulting from data entered or configured by the Customer, from permissions not granted or revoked, from the plan limit being used up or from KSeF unavailability. Our total liability in any 12 months is limited to the fees the Customer paid for the Service in those 12 months, and on the Free plan to PLN 100. Nothing in these terms limits liability that cannot be limited by law, including for intent or gross negligence.

10. Complaints and support

Complaints and questions about the Service are sent to kontakt@ksefshop.pl with a description of the problem and the account email. We answer within 14 days. Questions about orders, payments and refunds are handled by Paddle (see section 6 and the Refunds and cancellation policy); we help pass them on.

11. Termination, suspension and data export

11.1. The Customer may cancel the subscription at any time and may delete the account by writing to kontakt@ksefshop.pl. Deleting the account does not trigger a refund except as described in the Refunds and cancellation policy.

11.2. We may terminate the contract with 30 days' notice. We may suspend the account at once in case of a material breach of these terms (for example abuse, fraud, unlawful content or disclosure of keys to third parties) or a serious security risk, and will tell the Customer the reason.

11.3. Before the account is deleted, the Customer should download its invoices (API or panel). Issued invoices remain available in KSeF. We delete data as described in section 7.1 and the Privacy Policy.

12. Customer status

The Service is intended for businesses and is used in connection with their business activity. By opening an account the Customer confirms that it acts as a business. Mandatory rights that the law gives to a sole trader treated as a consumer (in Poland, art. 38a of the Consumer Rights Act) are not affected by these terms.

13. Governing law

These terms are governed by the laws of Ukraine. Disputes are settled by the court competent for the Provider's registered office. Mandatory rules of the Customer's country that cannot be excluded by agreement are not affected. If the Polish and English versions differ, the Polish version prevails.
