Terms of service

Last updated: 18 October 2026

1. Provider. KSeF Faktury (the "App") is provided by Lytvynov Production LLC (ТОВ «ЛИТВИНОВ ПРОДАКШН», EDRPOU 43293825), vul. Robocha 164-A, kv. 58, 49000 Dnipro, Ukraine, kontakt@ksefshop.pl, https://ksefshop.pl ("we"). These terms apply to the store owner who installs the App (the "Merchant").

2. Service. The App issues Polish VAT invoices (FA(3)) and correction invoices for paid orders of the Merchant's Shopify store and sends them to KSeF, the Polish National e-Invoicing System. It provides a NIP field in the cart, invoice PDFs in the Ministry of Finance layout with a QR code, an invoice block on the order page and status screens in the Shopify admin. The App currently covers orders of buyers with a Polish NIP, in PLN or in a currency of NBP table A (VAT converted to PLN at the NBP rate). KSeF is operated by the Ministry of Finance; its availability is outside our control. When KSeF is unavailable, invoices wait in the queue and are sent when it is back.

3. Merchant's responsibilities. The Merchant is the issuer of the invoices and is responsible for:

4. No tax advice. The App is a software tool. We do not provide tax, accounting or legal advice, and nothing in the App or our support is such advice. Consult a tax adviser for questions about your obligations.

5. Plans and billing. Plans and prices are shown on the App's listing and in the App. Charges are billed by Shopify on the Merchant's Shopify bill under Shopify's billing terms. A plan covers a number of invoices (VAT and corrections accepted by KSeF) per calendar month; over the limit, new invoices wait until the next month or an upgrade. Plan changes and cancellation are made in the Shopify admin. Refunds follow Shopify's rules for app charges.

6. Data protection. For buyer data we act as the Merchant's processor (art. 28 GDPR). We process it only to provide the App, as described in the Privacy Policy (https://ksefshop.pl/ksef-faktury/privacy), which forms part of these terms together with the following data processing terms: we keep the data confidential, use processors listed in the Privacy Policy (the Merchant authorises them and will be informed of changes and may object), apply appropriate security measures, help the Merchant answer data subject requests, report personal data breaches without undue delay and at most within 48 hours of becoming aware of them, and delete or return data at the end of the service, except invoices that must be kept by law.

7. Availability and changes. We aim for continuous availability but do not guarantee it. We may change the App, for example to follow changes of the FA schema or the KSeF API. We will give at least 30 days' notice of price increases.

8. Liability. We are not liable for indirect or consequential loss, lost profit, or tax penalties, interest or sanctions resulting from data entered or configured by the Merchant, from permissions not granted or revoked, or from KSeF unavailability. Our total liability in any 12 months is limited to the fees the Merchant paid for the App in those 12 months. Nothing in these terms limits liability that cannot be limited by law, including for intent or gross negligence.

9. Termination. The Merchant may uninstall the App at any time. We may suspend or end the service for breach of these terms with notice, or immediately in case of abuse. Before uninstalling, the Merchant should download its invoices; issued invoices remain available in KSeF.

10. Law. These terms are governed by the laws of Ukraine. Mandatory consumer or business protection rules of the Merchant's country are not affected.
